Overview
At Lark, we prioritize the privacy and data security of our clients and users (collectively referred to as "Customers"). We do not disclose Customer Data, as defined in our Customer Terms of Service or User Terms of Service (whichever is applicable), to government or law enforcement agencies unless directed by the Customer or mandated by law.
Information and Document Requirements
Each request should be signed, dated, and issued on official law enforcement letterhead. The request must contain the following details:
Information about the requesting law enforcement authority:
- •Requesting Authority (or Court): Include the name and location of the law enforcement authority. If the request comes from a Court order, indicate the location and name of the relevant Court and judge/magistrate.
- •Requesting officer: Provide the requesting officer’s name, badge/identification number, official email address, and phone number (including any direct dial extension).
Details of the relevant account:
- •When requesting data about a specific Lark user, you must include an approved account identifier linked to the account in question. We also recommend providing a screenshot of the relevant account for quicker identification. The following are Lark-approved identifiers:
- ◦User's account name
- ◦User‘s tenant name (or company name) (If Any)
- ◦User's registered email address
- ◦User's registered phone number
- •How to find Lark-approved identifiers?
Specific scope of data required:
- •Data requested: Specify the scope of the Customer Information requested. Overly broad requests will be rejected.
- •Date range: Specify a date (and, if possible, a time), or a date range pertinent to the request (only for historical data).
Legal basis for the request:
- •Each request must clearly specify the type of data requested and the legal basis for requesting it. If the request does not meet the applicable legal requirements for the requested data, the data will not be disclosed. This is in particular, the case for requests relating to content data (which generally require a domestic court / judicial order, warrant or equivalent).
- •Relevant legal process: The request should clearly specify the legal process (i.e. citing the relevant article or section of an Act / Statute / Code), which authorizes law enforcement to request and collect information for the purposes of prevention, detection or investigation of criminal offences.
- •Context and Offence(s) under investigation: The request should separately indicate the type of offence(s) under investigation (citing the relevant Act / Statute / Code), the circumstances of the offence and in what way it is connected to the Platform.
- •User notification: Please indicate whether user notification is permitted. It is our policy to notify Lark users before disclosing their data to law enforcement. However, the provision of such notice may be exempted under the following circumstances:
- ◦ (a) is prohibited under applicable law;
- ◦ (b) would jeopardize an ongoing investigation; and/or
- ◦ (c) would put individuals at risk of harm.
- ◦It is the responsibility of the requesting law enforcement authority to clearly indicate in their request whether any of these criteria are met. Lark commits to complying with these requests, given that sufficient supporting information is presented (for instance, if a request cites a non-disclosure obligation as per applicable law).
Assessment Criteria
The request must be a valid law enforcement request
- •Lark requires a legally valid request in compliance with applicable laws and regulations. Acceptable types of requests include subpoenas, court orders, search warrants, or their local equivalents issued by a court of competent jurisdiction. Lark will review each request on a case-by-case basis, subject to this Law Enforcement Request Guidelines ("Guidelines"), Lark's Customer Terms of Service, User Terms of Service, Privacy Policy, and applicable laws. We routinely challenge requests that are overly broad or otherwise unlawful. Additionally, Lark will assess whether the request aligns with internationally recognized standards, including human rights, due process, and the rule of law. Each request must be signed, dated, and issued on official law enforcement letterhead. We will not process requests lacking official documentation.
The request must be addressed to the correct Lark entity
- •Please ensure requests are addressed to the appropriate Lark entity, based on the user's location. Requests addressed to the wrong Lark entity may experience delays in processing until the error is corrected.
